Dark patterns are everywhere, including in the criminal justice system. A “dark pattern” connotes a manipulative user design or interface that decreases individual welfare . Websites and mobile apps notoriously incorporate dark patterns. Examples include disguised ads, one-click memberships that are difficult to cancel, and scarcity cues (e.g.: Hurry! Only one airline seat left at this price!).
This presentation shows how dark patterns permeate the criminal justice system and explores relevant reform initiatives. This presentation will be relevant to students with a range of interests, such as criminal law and procedure, criminal justice reform, behavioral economics, law and technology, anti-trust, consumer protection, private law, and more.
