The Power of Choice Architecture in Criminal Justice Reform.

Choice architecture is one of the most promising – yet overlooked – criminal justice reform tools. The concept of “choice architecture” refers to the background conditions for choice. The ways in which options are presented can shape outcomes significantly. Like how jurisdictions can increase organ donation rates when they change the scheme from opt-in to default enrolment, states can drastically improve criminal record expungement rates through similar means. This is just one example of choice architecture’s potential as a law reform tool. And there are many others.

This event provides an overview of choice architecture in criminal justice reform. Although the presentation focuses on the criminal justice system, its insights are equally valuable to other areas legal domains, fields of study, and to routine decision-making more generally.
